TERMS OF USE

ENERGYCoP is a global, not-for-profit community of practice launched in 2017 by the partners of the SET4Food Project. ENERGYCoP’s mission is to increase collaboration between humanitarian and energy actors by supporting the sharing of experiences from the field, discussion of emerging technologies and business models, joint problem-solving, and networking. All individuals and organizations interested in issues related to energy access and energy technologies in humanitarian settings can be part of ENERGYCoP by accessing its resources, connecting with partners, and contributing to ongoing discussions.

To help you gain the most from ENERGYCoP, please familiarize yourself with the following Terms of Use, as well as the Member guidelines. Both are designed to make your experience more productive and help you understand what kind of behavior is expected from users.

 

By using this platform, you are agreeing to comply with and be bound by the following Terms of Use. Please review them carefully. Failure to comply with these terms may result in automatic suspension or cancellation of your membership in the ENERGYCoP Community and the removal of any content you post.

 

  1. Acceptance of Agreement.

    By using the ENERGYCoP online platform and/or participating in the ENERGYCoP Community, you agree to the terms and conditions outlined in this Terms of Use Agreement ("Agreement") with respect to the platform (the "Platform"). This Agreement constitutes the entire and only agreement between ENERGYCoP’s administrators and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Platform, the content, products or services provided by or through the Platform, and the subject matter of this Agreement. This Agreement may be amended at any time by us from time to time without specific notice to you. The latest Agreement will be posted on the Platform, and you should review this Agreement prior to using the Platform.

  2. Administrators:

    The SAFE Humanitarian Working Group (SAFE WG), represented by its current Co-Chair organizations, currently manages the Platform and acts as administrator. These make up the collective “We” that is referred to in the following sections.

  3. Editing, Deleting and Modification.

    ENERGYCoP administratos reserve the right in our sole discretion to edit or delete content appearing on the Platform that violate any of these Terms of Use without prior notice. If you have a question for an administrator on a decision, you can contact them and discuss it privately. In order to do this, go to “Contact Us”.

  4. Indemnification.

    You agree to indemnify, defend and hold the Platform administrators, SET4Food partner organizations, the SAFE Humanitarian Working Group and our partners, attorneys, staff, advertisers, product and service providers, and affiliates (collectively, "Affiliated Parties") harmless from any liability, loss, claim and expense, including reasonable attorney's fees, related to your violation of this Agreement or use of the Platform.

  5. Code of Conduct

    As a user of the Platform, you agree to conform to the following rules of conduct at all times. Failure to adhere to these rules will result in immediate suspension and possible cancellation of your ENERGYCoP membership.

    1. Illegal Activity: You will not engage in any illegal activities (e.g. drug trafficking) through the Platform and will not incite any such acts. You will not make violent threats or use incendiary language.
    2. False Identity: You will not impersonate other community members or falsely claim to represent a person or organization.
    3. Obscenity: You will not use explicit, racist, obscene, or vulgar terms from any language  anywhere on the platform, including discussions, documents, and images.
    4. Defamation: You will not attack, insult, defame, or abuse other users on the Platform in any way. You agree to engage in disagreements or debates in a respectful manner. (Refer to the Member Guidelines for more information)
    5. Soliciting: You will not sell or excessively advertise products, companies, or services on the Platform. You will not link to advertising or "Spam". (Refer to the Member Guidelines for more information)
    6. Proselytizing: You will not post or upload content of an overtly political or religious nature.
  6. Nontransferablity.

    Your right to use the Platform is not transferable. Any password, user account, or right given to you to obtain information or documents in the Platform is not transferable to another individual or organization.

  7. Technology and Fuel Neutrality

    ENERGYCoP is a fuel and technology neutral Platform. We take no stance on whether one type of technology or energy source is “better” than another. As a user of the Platform, you agree to engage in discussion and/or debate regarding fuels and energy technologies in good faith and not in pursuit of personal or business interests. (Refer to the Member Guidelines for more information)

  8. Privacy Policy.

    Our Privacy Policy, as it may change from time to time, is a part of this Agreement. We will not share any personal information provided by you – including but not limited to your e-mail address, mailing address, phone number, or other contact details – with other users on the Platform or any outside parties unless granted explicit permission by you in writing.  In turn, you understand that any personal information you choose to share on the Platform is viewable to the public and is provided your sole risk and discretion. We bear no liability for how personal information on the Platform is used once you have provided it. Refer to Member Guidelines and Privacy Policy for advice on how to keep your information safe and secure.

  9. Public Domain.

    As a user of this platform, you acknowledge that any information or material you share within the Platform is neither proprietary nor confidential. ENERGYCoP’s administrators, partners, and donors are not liable should you share confidential or proprietary information.

  10. Use of Information.

    We reserve the right, and you authorize us, to the use and assignment of all information regarding Platform uses by you and all information provided by you in any manner consistent with our Privacy Policy. All remarks, suggestions, ideas, graphics, or other information communicated by you to us through the Platform (collectively, the "Submission") will forever be the property of ENERGYCoP. ENERGYCoP will not be required to treat any Submission as confidential, and will not be liable for any ideas for its business (including without limitation, product, service or advertising ideas) and will not incur any liability as a result of any similarities that may appear in future ENERGYCoP products, services or operations. Without limitation, ENERGYCoP will have exclusive ownership of all present and future existing rights to the Submission of every kind and nature everywhere. ENERGYCoP will be entitled to use the Submission for any commercial or other purpose whatsoever, without compensation to you or any other person sending the Submission. You acknowledge that you are responsible for whatever material you submit, and you, not ENERGYCoP have full responsibility for the Submission, including its legality, reliability, appropriateness, originality, and copyright.

  11. Copyright.

    The content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the Platform are protected under applicable copyrights, trademarks and other proprietary (including but not limited to intellectual property) rights. The copying, redistribution, use or publication by you of any such matters or any part of the Platform, except as allowed by Section 13 – Limited Right to Use, is strictly prohibited. You do not acquire ownership rights to any content, document or other materials viewed through the Platform. The posting of information or materials on the Platform does not constitute a waiver of any right in such information and materials. Contents, products and names mentioned on the Platform may be trademarks of their respective owners.

  12. Copyrights and Copyright Agents.

    We respect the intellectual property of others, and we ask you to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide us with the following information through our Contact Us form:

    1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
    2. A description of the copyrighted work that you claim has been infringed;
    3. A description of where the material that you claim is infringing is located on the Platform;
    4. Your address, telephone number, and email address;
    5. A statement by you that you have in good faith believe that the disputed use is not authorized by the copyright owner, its agent, or the law; and
    6. A statement by youthat the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

    Based on this information, we will ascertain whether material has been inappropriately attributed on the Platform and, if warranted, modify or remove it accordingly. This decision is at the sole discretion of ENERGYCoP’s administrators and cannot be overruled. Note that this decision only applies to the Platform, and any pursuit of legal action for copyright infringement must be addressed outside of the Platform.

  13. Limited Right to Use.

    The viewing, printing or downloading of any content, graphic, form or document from ENERGYCoP grants you only a limited, nonexclusive license for use solely by you for your own personal use and not for republication, distribution, assignment, sublicense, sale, or other use. No part of any content, form or document may be reproduced in any form or incorporated into any information retrieval system, electronic or mechanical, other than for your personal use (but not for resale or redistribution).

  14. Disclaimer and Limits.

    The information from or through the platform are provided "as-is," "as available," and all warranties, express or implied, are disclaimed (including but not limited to the disclaimer of any implied warranties of merchantability and fitness for a particular purpose). The information and services may contain bugs, errors, problems or other limitations. We and our affiliated parties have no liability whatsoever for your use of any information or service. In particular, but not as a limitation thereof, we and our affiliated parties are not liable for any indirect, special, incidental or consequential damages (including damages for loss of business, loss of profits, litigation, or the like), whether based on breach of contract, breach of warranty, tort (including negligence), product liability or otherwise, even if advised of the possibility of such damages. The negation of damages set forth above are fundamental elements of the basis of the bargain between us and you. This platform and the products, services, and information presented would not be provided without such limitations. No advice or information, whether oral or written, obtained by you from us through the platform shall create any warranty, representation or guarantee not expressly stated in this agreement. We do not provide legal advice nor enter into any attorney-client relationship.

    All responsibility or liability for any damages caused by viruses contained within the electronic file containing the form or document is disclaimed. We will not be liable to you for any incidental, special or consequential damages of any kind that may result from use of or inability to use our platform.

  15. European Union Disclaimer.

    "This document covers humanitarian aid activities implemented with the financial assistance of the European Union. The views expressed herein should not be taken, in any way, to reflect the official opinion of the European Union, and the European Commission is not responsible for any use that may be made of the information it contains."

  16. Third-Party Services.

    We may allow access to third-party technology or service providers ("Technology Manufacturers/Providers") from which you may purchase certain technologies or services. You understand that we do not operate or control the technologies or services offered by Technology Manufacturers/Providers. You understand that any transactions of technologies and services, explicit advertising of the same, or related correspondence is strictly prohibited on ENERGYCoP and must take place outside of the Platform. (See section 5(e) Code of Conduct – Soliciting). ENERGYCoP is not a party to the transactions entered into between you and Manufacturers/Providers. Manufacturers/Providers are responsible for all aspects of order processing, fulfillment, billing and customer service which should take place outside the platform. You agree that use of such Manufacturers/Providers is at your sole risk and is without warranties of any kind by us, expressed, implied or otherwise including warranties of title, fitness for purpose, merchantability or non-infringement. Under no circumstances are we liable for any damages arising from transactions between you and manufacturers/providers or for any information appearing on manufacturers/providers’ platforms or any other platform linked to our platform.

  17.  Third-Party Technology Manufacturers/Providers Policies.

    All rules, policies (including privacy policies) and operating procedures of Manufacturers/Providers will apply to you while on such platforms. We are not responsible for information provided by you to Manufacturers/Providers. We and the Manufacturers/Providers are independent contractors and neither party has authority to make any representations or commitments on behalf of the other.

  18. Links to Other Web Platforms.

    The Platform contains links to other websites and platforms. We are not responsible for the content, accuracy or opinions express in such web platforms, and such web platforms are not investigated, monitored or checked for accuracy or completeness by us. Inclusion of any linked web platform on our Platform does not imply approval or endorsement of the linked web platform by us. If you decide to leave our Platform and access these third-party platforms, you do so at your own discretion.

  19. Miscellaneous.

    This Agreement shall be treated as though it were executed and performed in Italy, and shall be governed by and construed in accordance with the laws of Italy (without regard to conflict of law principles). Any cause of action by you with respect to the Platform (and/or any information, products or services related thereto) must be instituted within one (1) year after the cause of action arose or be forever waived and barred. All actions shall be subject to the limitations set forth in Section 14- Disclaimer and Limits and in Section 16- Third-Party Services. The language in this Agreement shall be interpreted as to its fair meaning and not strictly for or against either party. All legal proceedings arising out of or in connection with this Agreement shall be brought solely in Italy. You expressly submit to the exclusive jurisdiction of said courts and consent to extra-territorial service of process. Should any part of this Agreement be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. To the extent that anything in or associated with the Platform is in conflict or inconsistent with this Agreement, this Agreement shall take precedence. Our failure to enforce any provision of this Agreement shall not be deemed a waiver of such provision nor of the right to enforce such provision.

 

PRIVACY POLICY

  • INTRODUCTION

    This page describes how the ENERGYCoP platform is managed in relation to the processing of the personal data of its users. This privacy policy, in accordance with  Article 13 of Legislative Decree no. 196/2003 – Data Protection Code, provides information to those who interact with the ENERGYCoP platform, which can be accessed electronically and pertain to the domain: www.energycop.safefuelandenergy.org/. This privacy policy is issued solely in relation to the ENERGYCoP platform.

    The information provided is also based on the guidelines contained in Recommendation no. 2/2001, which was adopted on 17 May 2001 by the European data protection authorities within the Working Party set up under Article 29 of European Directive 95/46/EC in order to lay down minimum requirements for the collection of personal data online – especially with regard to arrangements, timing and contents of the information to be provided by data controllers to users visiting web pages for whatever purpose.

  • DATA CONTROLLER

    As a result of the use of this platform, data relating to identified or identifiable individuals may be processed. The owner, Data Controller and the person in charge of processing the data provided by the user of this platform is Safe Access to Fuel and Energy (SAFE) working group, USA and Politecnico di Milano.

  • PLACE OF DATA PROCESSING

    The processing connected with the web services of this platform takes place at the SAFE  and / or at the offices of external providers offering specific services to the SAFE, including entities/authorities for the issuance of public key certificates and entities/companies that analyse data on website usage. The personal data supplied by users requesting information material are used solely to execute the service or performance requested and are communicated to third parties only where it is necessary or required by laws or regulations. Such personal data may be communicated to external, public or private parties solely for purposes connected with Polisocial activities.

  • TYPES OF DATA PROCESSED

    NAVIGATION DATA

    The IT systems and software procedures that ensure the functioning of this website, acquire personal data, in the course of their ordinary operations, whose transmission is implied in the use of Internet communication protocols. This information is not collected to be associated with identified interests; yet, by reason of its nature, it may lead to the identification of users when processed and associated with third party data. This category of data includes IP addresses or domain names of the computers of users connecting to the platform, URI (Uniform Resource Identifier) addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the number code indicating the status of the response given by the server (successful, error, etc.) and other data relating to the operating system and IT environment of the user. These data are used solely to obtain anonymous statistical information on platform  usage and to control its correct operation. Such data may be used to establish liability in case of potential computer crimes to the detriment of the website.

    DATA SUPPLIED VOLUNTARILY BY THE USER

    The optional, express and voluntary sending of emails to the addresses indicated in this website implies the subsequent acquisition of the sender’s address, which is required to answer his/her requests, and any other personal data included in the message. Any personal data supplied voluntarily by users will be processed to execute the ENERGYCoP activities, subject to the limits laid down in laws, regulations, Terms of use and in accordance with the general principles of transparency, fairness and confidentiality set out in Legislative Decree no. 196/03.

    COOKIES AND WEB BEACONS

    The management of the ENERGYCoP platform uses a specific technology called “cookies”. These are small text files that are stored on the user’s computer when s/he accesses the website or parts thereof. Cookies provide information on which section of the website is the most popular, on users’ platform navigation experience and length of visit. Cookies are used to examine website/platform traffic in order to improve website/platform performances and meet the interests and preferences of website/platform visitors. Cookies are also used by websites/platforms that provide counters to our website/platforms. Recording and track/route management activities are performed in such a way as to make data not identifiable. Cookies may also be used to recognize the user’s computer every time the user visits the website/platform. This allows users to save time, e.g. visitors are not required to register every time they visit the website/platform or they are helped to customize their Internet settings. Our platform may use web beacons. This technology is used to understand which visitors click the key features (e.g. links or images) of a page or email. Web beacons are usually used together with cookies. If the user does not intend to accept cookies, these can be disabled following the instructions given by his/her browser producer; however, this might prevent the user from fully using the platform.

  • METHOD OF DATA PROCESSING

    Personal data will be processed via automated means for the time that is strictly necessary to achieve the purposes of their collection. Specific security measures are taken to prevent the loss of data, the unlawful or incorrect use of data and any unauthorized access thereto.

  • OPTIONAL SUPPLY OF DATA

    Apart from the above points on navigation data, users may freely supply their personal data included in the forms available on the ENERGYCoP platform or otherwise provided when contacting us, in order to request information material or other communications or to have access to specific services. Non-supply of data may prevent the user from enjoying the service.

  • RIGHTS OF THE PERSONS CONCERNED

    The persons whom the personal data refer to may ask at any time to have confirmation as to the existence of such data and to know about their content and origin, to check their accuracy or ask for their integration, update or rectification (Article 7 of Legislative Decree no. 196/2003). In accordance with the same article, the person concerned may ask for the cancellation, transformation into an anonymous form or block of data processed against the law, and may in any event object to their processing for legitimate reasons.

  • LINKS TO OTHER WEBSITES

    Pages of the ENERGYCoP platform may include links to other websites or platforms that are not managed by the ENERGYCoP platform. The ENERGYCoP team does not exchange personal data with these websites or platfroms. The ENERGYCoP platform is not responsible for the content, security or privacy measures taken by other websites or platforms and will not be held liable therefore.
